Busia Governor Paul Otuoma has been sued following a viral video showing him kicking a man during an official event where the county chief was distributing seeds to residents with the victim now seeking a compensation of 100 million shillings.

The petitioner Yusuf Suleiman Hamisi a 31-year-old boda boda rider; through lawyer Danstan Omari has claimed that he was denied medical attention in both Busia and neighboring Siaya county at the instructions of his aggressor.

“Our client was denied a P3 at Sio Port in Busia, he went to the neighboring Siaya County where he was also denied medical services. In Siaya he was abducted by heavily armed men.” Omari has said.

“Our client sneaked to Nairobi where he was treated and given a P3 at Mbagathi Hospital.” The lawyer has added.

Lawyer Omari confirmed that the case will be heard in Nairobi after his client expressed fears for his security if proceedings are held in Busia.

“We informed the Judge that we as lawyers are not sure of our security if the case is heard in busia where the governor has influence.” Omari has said.

The lawyers have also called for the removal of the governor from office on grounds of failing the integrity test.

Omari has cited the Nancy Baraza case where the former Deputy Chief justice was removed from office for pinching a security guard at the Village Market in Nairobi in 2012.

“We have also requested the judge to order the Speaker and county assembly of Busia to begin impeachment proceedings against the county chief.”
