A case by the husband of Rose Kimwatu, the former Head of Data Protection at KCB Bank has been closed.
The Milimani Law Courts closed the file after Kelvin Migwe Kimwatu – the husband of the accomplished lawyer sought to withdraw his petition saying he would leave what had happened to God and chose not to pursue further legal action over the burial.
Kelvin had sought to block the burial seeking to be involved in arrangements to inter the remains of his late wife.
The family of Rose however proceeded to bury her at 7:30 pm in a ceremony they say was in line with the tradition of the Kalenjin community.
“The applicant withdrew the application, and we had no objection to the application and the entire suit being withdrawn,” Lawyer Felix Keaton, representing the parents of the deceased, said.
“We take the view that that was a wise decision; we also wish to convey to you that they (parents) welcome the son-in-law together with the children or any other family member to visit the graveside of the deceased or even visit the family at any particular time,” he added.
The late Rose was found dead at her home Ole Nairi in Ngong Kajiado County with an autopsy carried out by the Chief Government Pathologist Jahnsen Oduor revealing that she committed suicide.
